Lawful Presence Forms

REQUIRED Lawful Presence Forms

As a result of a law change to O.C.G.A. § 50-36-1, the Georgia Soil and Water Conservation Commission (Commission) is required to obtain a signed and sworn affidavit verifying the applicant’s lawful presence in the United States accompanied by a copy of at least one “secure and verifiable document.” O.C.G.A. § 50-36-1(e).
Below is a link to this Memorandum.  There is also a Checklist for Verification of Lawful Presence within the United States (Checklist) along with three different affidavits from which the applicant must choose that provide the basis for his or her lawful presence in the United States. The Checklist must be completed by an applicant to identify which of the three types of affidavits and which one of the 16 secure and verifiable documents listed is being submitted to the Commission.
WHAT TO DO:
1.)  Read this FIRST:

2.)  Fill out this form: Checklist
3.)  Then based on the answers on the checklist, choose from one of these forms, fill it out and HAVE IT NOTARIZED:
       a.)  
US Citizen Affidavit
       b.)  Qualified Alien or Nonimmigrant Affidavit
       c.)  Legal Permanent Resident Affidavit
4.)  Copy your Driver's License or other authorized document
5.)  Send the three documents (be sure that the affidavit is notarized) to:

**Note:  Please be sure that the copy of your driver's license is legible (not too dark) 
if you are faxing your documents.

Applicants will be notified only by email that their citizenship has been verified. Verification of citizenship can take up to 5 business days.

For your records, it is recommended that each applicant keep a photocopy of all of the documents that he or she submits to the Commission to verify his or her lawful presence in the United States in case any issue arises as to whether the applicant has submitted a complete and correct copy of what must be provided.

Failure to provide the documentation called for by this Memorandum will prevent an Applicant from having his or her certification or re-certification issued and may result in his or her certification being revoked.
